VIDLISH Terms of Use

1. Service provider and hosting

VIDLISH is provided on a non-professional basis by Florian MONTAIGNE, a natural person.

To protect the privacy of the non-professional publisher, the publisher’s home address and personal telephone number are not made public. Article 1-1 II of French Law No. 2004-575 of June 21, 2004 on confidence in the digital economy allows a non-professional online publisher to make only the hosting provider’s details public, provided the required identifying information has been supplied to that provider.

The public VIDLISH legal website is hosted through Cloudflare Pages, a service of Cloudflare, Inc.:

2. Purpose

VIDLISH is an English-learning application based on video content, including videos available through YouTube. Depending on the features available, VIDLISH may provide:

  • video browsing and playback;
  • transcripts and learning resources;
  • a Study mode;
  • quizzes;
  • flashcards and memorization features;
  • activity and progress tracking;
  • favorites, search and personalized recommendations;
  • learning preferences and application settings;
  • learning-related notifications.

VIDLISH is a learning tool. It is not a certification body and does not guarantee that a user will reach any specific language level.

3. Acceptance

By using VIDLISH, you agree to these Terms of Use.

The Privacy Policy separately explains how personal data is processed. Acknowledging that policy does not amount to blanket consent to all processing activities; each processing activity relies on its applicable legal basis.

If you do not agree to these Terms, you must not use VIDLISH.

4. Access

VIDLISH may be used:

  • in guest mode, with limited or non-persistent features depending on the case;
  • through a VIDLISH account associated with Google authentication, allowing VIDLISH to restore preferences, learning history, progress and other personalized data.

Some features may be unavailable in guest mode.

You are responsible for maintaining the security of your device and Google account.

5. Minors

VIDLISH is not specifically designed as a service for children.

In France, users under 15 may require the involvement and authorization of a parent or legal guardian for certain data-processing activities based on consent. More generally, minors should use VIDLISH under the responsibility of their legal representative where required by applicable law.

6. YouTube and third-party content

VIDLISH uses services and content provided by YouTube and Google, including YouTube API Services and an embedded YouTube player.

Videos remain provided by YouTube and their respective rights holders. VIDLISH does not acquire ownership of videos, channels, trademarks, thumbnails or other third-party content displayed in the application.

By using VIDLISH features that rely on YouTube, you also agree to be bound by the YouTube Terms of Service:

Use of Google and YouTube services may also be governed by their own policies and terms.

VIDLISH is not intended to bypass YouTube restrictions, download or redistribute videos outside the functionality permitted by the services used, or request your YouTube login credentials.

The availability of videos, captions, playback or metadata may change independently of VIDLISH.

7. Learning resources and artificial intelligence

Translations, explanations, quizzes, flashcards, level classifications and other learning resources may be generated or prepared automatically from available content, including through artificial-intelligence services.

Within V1, AI is mainly used server-side to prepare learning resources associated with catalogue videos and transcripts. The recommendation engine and ordinary learning flows are deterministic and do not require sending the VIDLISH account identity or personal learning history to an external AI model in real time.

Despite quality controls, these resources may contain errors, approximations or imperfect wording. They are learning aids and should not be treated as guaranteed linguistic, academic or professional references.

8. Recommendations and personalization

For signed-in users, VIDLISH may personalize recommendations based on declared preferences and learning activity.

These recommendations are solely educational and do not produce legal or similarly significant effects.

9. Notifications

When enabled by the user, VIDLISH may send notifications to remind the user about a review, surface relevant learning activity or facilitate resuming learning.

Notification preferences can be changed in the application and, where supported, in the device operating-system settings.

10. Acceptable use

You must use VIDLISH in compliance with applicable law and these Terms.

You must not:

  • attempt to gain unauthorized access to systems, accounts, data or infrastructure;
  • interfere with or bypass security mechanisms or technical limitations;
  • use VIDLISH to infringe third-party rights;
  • mass-extract, copy or redistribute content in violation of applicable rights or provider terms;
  • use VIDLISH, YouTube or related APIs in a manner prohibited by applicable terms.

11. Intellectual property

Subject to rights held by YouTube, Google, video creators and other third parties, the elements specific to VIDLISH — including its name, visual identity, interface, original text, functional organization and software — are protected by applicable intellectual-property laws.

No ownership rights in VIDLISH are transferred to users.

12. Availability and changes

VIDLISH may evolve to fix issues, improve the experience, adapt functionality, comply with legal or technical requirements, or reflect changes imposed by third-party services.

Features may be temporarily unavailable, modified or removed.

VIDLISH does not guarantee uninterrupted availability or complete absence of errors.

13. Account and history deletion

Where available in the application, privacy controls allow users to:

  • clear relevant learning history while keeping their account and preferences;
  • delete their VIDLISH account and associated data as described in the Privacy Policy.

Deleting a VIDLISH account does not delete the user’s Google account or data independently held by Google or YouTube.

14. Liability

VIDLISH is provided as an educational tool.

To the extent permitted by law, the publisher is not liable for outages or changes attributable to YouTube, Google, networks, operating systems, app stores, hosting providers or other third-party services.

Nothing in these Terms limits mandatory consumer rights or any liability that cannot lawfully be excluded or limited.

15. Personal data

Personal-data processing is described in the VIDLISH Privacy Policy.

16. Paid features

This version of the Terms reflects the current V1 scope and does not include detailed subscription terms.

If VIDLISH introduces subscriptions or paid purchases, additional commercial terms must be presented before purchase and address price, billing, renewal, cancellation, applicable consumer rights and relevant app-store rules.

17. Changes to these Terms

These Terms may be updated when the service, applicable law or third-party services change.

Where required, users will be appropriately informed of material changes.

18. Governing law

Subject to mandatory consumer-protection rules, these Terms are governed by French law.
